Jurisdiction / Applicable Law: These Terms and Conditions of Swiss Rent a Car GmbH are governed exclusively by Swiss law. The place of jurisdiction for all disputes between the contracting parties is Zurich, Switzerland.
1.1 A valid driver’s licence is required for all rentals:
a) Passenger cars & minibuses up to 8+1 seats (3.5t): Category B
b) Minibuses up to 16+1 seats (3.5t): Category D1
c) Buses with more than 16+1 seats: Category D
d) Trailers over 750 kg gross weight: Category E
If no valid licence is shown, the lessor may refuse vehicle handover.
2.1 If the requested vehicle model is unavailable, a similar model from the same category will be reserved.
2.2 The vehicle must be collected and returned at the agreed time. Delays may incur additional fees.
2.3 After the rental period, the lessor reserves the right to reclaim the vehicle at the renter’s expense.
Vehicles are provided with a full fuel tank, in safe and clean condition, and must be returned in the same state. The rental agreement is issued upon presentation of a valid driving licence and ID. Any existing damage is recorded in the contract.
The vehicle may be collected via key safe if the contract has been completed and the deposit paid in advance. Any complaints must be reported to Swiss Rent a Car GmbH before the rental begins.
5.1 The vehicle may not be used for:
a) Driving lessons, racing or training events
b) Towing other vehicles
c) Providing false personal information
d) Driving under the influence of drugs, alcohol or medication
e) Driving in an unfit condition or with an unroadworthy vehicle
f) Driving through water or off-road areas
g) Commercial transport or transport of hazardous/explosive materials
5.2 The renter must handle the vehicle with care and ensure its roadworthiness.
5.3 Repairs during the rental period must, where possible, be carried out by an authorised brand service centre. Upon presentation of a receipt, costs are refunded unless the damage was caused by negligence. Replaced parts must be returned.
5.4 The vehicle may only be driven by the authorised renter(s) listed in the agreement.
5.5 Driving abroad is only permitted if agreed in advance.
5.6 In the event of an accident, fire, theft or similar incident, the renter must immediately notify the lessor and police. The renter must take all reasonable measures to minimise damage and obtain a police report.
The following damages are not covered, even if liability reduction was purchased: tyre damage, lost keys, rims, mirrors, antenna, interior damage or mechanical damage due to negligence. A minimum deductible of CHF 200 applies to all such cases.
7.1 Third-party liability: Unlimited coverage (deductible CHF 1,000)
7.2 Comprehensive insurance: Unlimited coverage (deductible CHF 1,000)
7.3 Passenger insurance:
a) Each passenger is covered
b) Death: CHF 30,000
c) Permanent disability: CHF 100,000
d) Daily allowance from day 1: CHF 20
e) Medical expenses as agreed
If a technical problem occurs, proceed as follows:
a) Contact the 24 h Swiss Rent a Car helpline – International: +41 76 716 66 66 / Switzerland: 076 716 66 66 or 078 300 90 90
b) Contact the roadside service listed in the vehicle handbook (e.g. AXA Winterthur Intertours, 24 h line 0800 809 809).
All required insurance documents are inside the vehicle. Follow the insurance provider’s instructions.
The renter/driver must:
a) Immediately inform Swiss Rent a Car (+41 76 716 66 66 / +41 78 300 90 90) and the police
b) Complete the European Accident Report (in the vehicle)
c) Record the names and addresses of involved parties and witnesses
The renter must not admit liability or make commitments to third parties.
Driving abroad requires prior approval. In case of an accident abroad, the same reporting duties as above apply.
Children under 12 years of age or shorter than 1.50 m must use an appropriate child seat as required by Swiss law.
The renter is responsible for obtaining customs and transport documents and any necessary permits for international transport.
Smoking inside the vehicle is strictly prohibited. Violations will be treated as special cleaning and charged accordingly.

Credit cards: MasterCard / Visa / American Express / PostFinance Card.
For cancellations confirmed via email, phone or post, the following fees apply:
• 14 days in advance: CHF 45 processing fee
• 7 days in advance: 10 % of rental amount (max CHF 200)
• 3 days in advance: 30 % of rental amount (max CHF 500)
• 1 day in advance: 60 % of rental amount (max CHF 500)
• After rental start: 100 % of rental amount
Incorrect refuelling may cause costs up to CHF 1,000, which will be charged to the renter.
The renter is responsible for refuelling. Vehicles must be returned with a full tank. Otherwise, a refuelling fee of CHF 150 will be charged.
The renter is liable for all fines and violations incurred during the rental. Unpaid fines will result in an administrative surcharge of CHF 150.
The vehicle may be returned after hours by depositing the key in the Swiss Rent a Car key safe. The renter must inform the company via phone or email. The renter remains liable for any damage until the next business opening.
Some vehicles are equipped with GPS tracking for safety and recovery purposes. By signing the rental agreement, the renter agrees to the use of such systems. Data is used solely for recovery and not shared with third parties.
